报复社会来澄清冤案的声明

全国广大网民朋友：
声明人：是一个在网上轰动全国并被几千万网民点击和评论的湖北省黄冈市第二届人大代表。罗田县第十、十一、 十二、十三、十四届人大代表范桂峰（尽管被有关机关大量的删除和关闭声明人的网帖，但其中凤凰论坛网到目前 为止单帖浏览达110多万次，请上网查看。）在此首先感谢全国各大网站和板主以及广大网友和新闻媒体的支持 和报道。
由于声明人的案件于2009年2月份向湖北省高级人民法院提出了申诉请求，并于2010年4月13日收到省 高院提审通知书，但近期听到黄冈市、罗田县两级司法机关的有关人员透露，省高院审监庭主审声明人案件的主审 法官王意，受少数领导人的指使，到黄冈市、罗田县找市、县两级司法机关名曰调查案件，实属违法“和谐案件” 保市、县两级违法办案的司法人员，逃避法律的查处，想活活的冤死声明人，再说，哪有如此调查的道理呢？正因 为声明人在市、县两级人代会上提了司法人员的意见，得罪了市、县两级司法界的重要领导人，他们才组织公、检 、法、司等机关联合打击报复声明人，合伙办的冤案，找他们调查能对声明人有利吗？能说出真相吗？为什么不调 查大量知情人的证据呢？特别是其中所谓与熊楚国、林桂英的纠纷中，声明人在事发时就向河铺派出所报了警（是 群众的打架纠纷，声明人是履行职务），并有叶、熊俩位警官及时赶到了现场，并当场收缴了徐明权、林桂英等杀 人的菜刀、剪刀等凶器，还将徐明权、林桂英带到了河铺派出所，事后几天叶、熊俩位警官找知情人取了大量的证 据材料，为什么在一审、二审和再审时声明人和其律师一再请求调出该材料和杀人的凶器菜刀、剪刀，而这些审判 法官，不但不调出该材料，而且在判决书上对徐明权、林桂英等杀人的凶器菜刀、剪刀只字不提呢？象这样在第一 现场接近真实取证的第一证据材料，为什么不调出来呢？而声明人再三的用邮寄和当着主审法官王意的面请求（同 时将大量的证据材料用挂号信向省高院正副院长及有关办案法官，邮寄50多封（份）诉求信件，有据可查），调 出该证据，为什么王意法官不去调查呢？难道调查市、县两级司法机关的言词和写出的证明就能代表和作为声明人 有罪的证据使用吗？因为现在是法治社会，是以事实为依据，以法律为准绳，不是以前阶级斗争为纲的时代了。那 个时候是领导人和司法机关说了算，他们说的就是证据，就是法律，而法治社会的今天是以事实和证据为根据，是 法治而不是人治。至于声明人被判刑坐牢，对声明人来说，现在并不重要（因为牢已坐满了，1年半的徒刑坐了2 年半，还多坐1年）现在重要的是，“士可杀，不可辱”。如果声明人的三起纠纷是申诉人所为，没有时间和地点 ，那还情有可原，而这三起纠纷是办案人员陈选明和几个与声明人有仇恨的流氓、地痞和声明人送去坐牢的几个“ 两牢”人员在一起捕风捉影，张冠李戴、胡搅蛮缠捏造办成的一个假案。当然声明人的冤屈如果是为了党和人民利 益的需要，声明人愿意放弃和付出，从此不再上访申诉，更不会报复社会，因为法院保护的是损害党和人民利益的 违法犯罪人员，这些违法犯罪的司法人员不除，他们还要继续祸害其他人民群众。正如河南省高级人民法院张立勇 院长说：“司法不公，是最大的不公，司法腐败，是最大的腐败，动摇的是公民对法律的信仰，破坏的是法治社会 的根基，司法人员的素质差，必须加深老百姓对司法公正的疑虑。因此必须要有确实充分的证据来证明是声明人所 为。而且声明人的要求非常低调，改不改判声明人无罪，甚至还加声明人10年、20年的徒刑，声明人都愿意认 可，只是要求要事实求是的真相，只要不冤明说，一切都好说。
综上述，从省高院审监庭主审法官王意的枉法调查来看，声明人在此必须慎重的声明。
省高院审监庭必须严格依法、公正、事实求是的审判声明人的案件，按照最高人民法院王胜俊院长在2009年1 2月18日全国政法工作电视电话会议上的讲话和江必新副院长在2009年12月3日召开全国法院审判监督工 作经验交流视频会上的讲话以及2010年5月30日“两高三部”发布的两个规定，将声明人的三起纠纷的时间 、地点、事因、扣押物品清单上的物证等证据一一作出说明和解释清楚，并调出河铺派出所在现场的第一取证材料 和杀人的凶器菜刀、剪刀。让事实说话，让证据作根据，让声明人心服口服，息诉罢访。否则声明人要报复社会， 用车装满汽油到人群密集的地方制造恶性案件，震惊全中国乃至全世界并叫其儿子到国外申请政治避难和宣传声明 人的冤案（声明人的儿子早就办有世界通用护照）。来澄清声明人的冤案，声明人说到做到。因为声明人是一个军 人出身，承受不了这一奇耻大辱，到那时造成上百无辜人民群众的生命和国家集体财产的损失，应由王意法官来承 担？还是由受意的领导来承担呢？如果声明人是无理取闹，蓄意闹访、缠访，造成无辜人民群众的生命和国家集体 财产损失，那声明人不但不是人，连畜生都不如。为什么全国多起发生杀害法官的案件发生后，人们燃放鞭炮，拍 手称快呢？因为最黑暗的地方是人民法院，最胆大枉为的也是人民法院，声明人在浏览网页时，看到一网友的帖子 说：“打黑除恶，要先打法院”，这说明了什么呢？？？希望广大人民群众要理解声明人的做法是出于无奈，是走 途无路，有话无处说，有冤无处伸，只有采取违法犯罪的方式来惩处司法黑暗和腐败的违法犯罪人员。此作法尽管 声明人在这个问题上成了人民的罪人，对不起无辜的受害者，但对于声明人的案件来说，是能够澄清的，不会受辱 。再说声明人宁愿犯滔天杀头之罪，粉身碎骨，遗臭万年（因为那是明显的犯有罪，不是冤枉和受辱死的，能闭上 眼睛）也决不会受辱活在人世上。中国的现行法律，是写给人民群众看的，就连2010年5月30日“两高三部 ”发布的两个规定，对办案法官来说也只是一纸空文，在贯彻执行中完全是两回事。因此声明人只有采取报复社会 的办法来澄清这一冤案，否则其冤案永远是石沉大海，这样活着比死更难受。
